Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Eternity online store (the “Store”), operated by Shop Eternity Pty Ltd (ACN 699 123 709) (“we”, “us”, “our”) — the official online store of Thanksgiving Australia. By browsing the Store or placing an order, you agree to these Terms. Please read them carefully.

1. About Eternity

Eternity is the e-commerce store of Thanksgiving Australia, an ACNC-registered charity with DGR status. Proceeds from sales help fund medical and educational projects across 28 rural villages in Cambodia, the Philippines, Egypt and Nepal.

2. Eligibility

You must be at least 18 years old, or have the consent and supervision of a parent or guardian, to place an order. You agree to provide accurate, current and complete information when purchasing.

3. Products & availability

We take care to describe and display our products accurately; however, colours, sizing and finishes shown online are indicative and may vary slightly. All products are subject to availability, and we may limit quantities, modify or discontinue any product without notice.

4. Pricing & payment

All prices are in Australian Dollars (AUD) and include GST where applicable, unless stated otherwise. We make every effort to ensure pricing is correct but reserve the right to correct errors. Payment is processed securely by our payment providers (such as Shopify Payments, PayPal and buy-now-pay-later providers). Your order constitutes an offer to purchase; a contract is formed only when we dispatch your order.

5. Orders & cancellation

We reserve the right to refuse or cancel any order, including where there is a pricing or product error, stock is unavailable, or we suspect fraudulent or unauthorised activity. If we cancel an order you have paid for, we will refund you in full.

6. Shipping & delivery

Delivery is governed by our Shipping Policy. Risk in the goods passes to you on delivery. Delivery timeframes are estimates only and are not guaranteed.

7. Returns & refunds

Returns, exchanges and refunds are governed by our Returns & Refund Policy. Nothing in these Terms excludes your rights under the Australian Consumer Law.

8. Intellectual property

All content on the Store — including text, designs, graphics, logos, photographs and the Eternity and Thanksgiving Australia marks — is owned by us, Thanksgiving Australia, or our licensors, and is protected by law. You may not copy, reproduce or use it without our prior written permission.

9. Acceptable use

You agree not to use the Store for any unlawful purpose, to infringe our or any third party’s rights, or to interfere with the operation or security of the Store.

10. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms limits these rights.

11. Limitation of liability

To the maximum extent permitted by law, and subject to the consumer guarantees referred to above, our liability for any claim arising from your use of the Store or any product is limited, at our option, to the resupply of the goods or the cost of resupply.

12. Privacy

We handle your personal information in accordance with our Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page, and your continued use of the Store constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
